Welcome to Moosky AI. By accessing or using our website, you agree to these Terms & Conditions ("TOCs"). Please read them carefully.

• "Service" means Moosky AI's website and AI video generation tools.
• "Credits" are digital tokens you purchase, or receive with a subscription, to run video generations.
• "Credit Pack" means a one-time purchase of Credits.
• "Subscription" means a paid plan (Starter, Creator, or Studio) that renews automatically until you cancel it. See Section 11.

We grant you a limited, non-exclusive, non-transferable license to use the Service in compliance with these TOCs.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use.

4.1 Credit Packs

• Credit Packs are one-time purchases at $0.01 per Credit (100 Credits for $1).
• Credits from Credit Packs do not expire. They are used up only when you run a generation, or removed if your account is terminated.

4.2 Subscription Credits

• Each subscription plan grants a fixed number of Credits every month, as listed in Section 11.1.
• Subscription Credits expire at the end of the monthly period in which they are granted. They do not roll over to the next month, and unused subscription Credits are not refundable.
• On a yearly plan, Credits are released one month at a time, not all at once, and each month's Credits expire at the end of that month.
• If you cancel, Credits already granted for the current period stay usable until they expire. No new Credits are granted after your subscription ends.

4.3 Using Credits

• When you run a generation, we use the Credits that expire soonest first. In practice, subscription Credits are used before Credit Pack Credits.
• Each generation deducts the specified credits.
• You acknowledge that credit consumption is irreversible except as noted in our Refund Policy.

• No unlawful, harassing, or infringing content.
• No attempts to reverse-engineer, scrape, or disrupt our Service.

We reserve the right to suspend or terminate accounts for violations of these TOCs, at our sole discretion.

We sell Credit Packs and subscription plans for AI video generations. This policy explains when refunds are allowed.

• No refunds for credits already spent on successful generations.
• If a generation fails to produce any output due to system error, you may request a credit reinstatement.
• Unspent credits are non-refundable due to processing and transaction fees.
• Subscription fees are not refundable once a billing period has started, unless the law requires otherwise or we agree to a refund. See Section 11.6.

All videos produced by Moosky AI are generated algorithmically and may contain inaccuracies or distortions. You use the generated content at your own risk. We do not guarantee accuracy or reliability.

9.1 Static Content Ownership

All text, images, graphics, and code are owned by Moosky AI or licensors. Unauthorized use is prohibited.

9.2 User-Generated Content

• You retain ownership of generated videos.
• You grant Moosky AI a worldwide, royalty-free license to host and distribute content.

9.3 Use of Copyrighted Materials

• Do not use copyrighted material without permission.
• Ensure proper authorization if using organizational assets.
• You are solely responsible for compliance.

9.4 Likeness and Voice

Users must obtain explicit consent before using an individual's likeness or voice.

• Voice cloning
• Image animation
• Synthetic media generation
• Unauthorized use may lead to suspension and legal consequences.

9.5 DMCA Notice

Report copyright issues to copyright@moosky.ai.

9.6 Liability Disclaimer

• Service is provided "as-is".
• Users assume full responsibility for misuse.
• You agree to indemnify the platform.

We retain generated content for 90 days, after which it may be deleted.

• Account data is retained as required by law.
• Request early deletion via support@moosky.ai.
• While your subscription is active, your renders are private (they are not shown publicly) and we do not archive or delete your content.
• After your subscription ends, the 90-day retention above applies to your content.

11.1 Plans and Prices

• Starter: $20 per month, with 2,400 Credits each month.
• Creator: $50 per month, with 6,000 Credits each month.
• Studio: $120 per month, with 14,400 Credits each month.
• Yearly plans cost 7% less than twelve months of the monthly plan and are billed once, upfront, for the whole year: Starter $223.20, Creator $558, Studio $1,339.20 per year. Credits on a yearly plan are released monthly, as described in Section 4.2.
• Prices are in US dollars. Applicable taxes are calculated at checkout.

11.2 Automatic Renewal

• Your subscription renews automatically at the end of each billing period until you cancel. Monthly plans renew every month. Yearly plans renew every year.
• By subscribing, you authorize us and our payment processor to charge your payment method the plan price, plus any applicable taxes, when you subscribe and at the start of each renewal period, at the price in effect at that time, until you cancel.
• We will email you a reminder 15 to 45 days before a yearly plan renews, and at least once a year for monthly plans. The reminder will state the plan, the price, and how to cancel.

11.3 How to Cancel

• Sign in and open the Credits page (moosky.ai/credits). In your subscription summary, select "Cancel", then select "Yes, cancel at period end" to confirm.
• You can also select "Manage" to open our payment provider's customer portal, where you can cancel, update your payment method, and view your invoices.
• You can cancel online at any time, without contacting us. If you need help, email support@moosky.ai.
• Cancellation takes effect at the end of your current billing period. Your plan stays active until then, we will not charge you again, and Credits already granted for the current period remain usable until they expire.

11.4 Failed Payments

• If a renewal payment fails, your subscription is marked past due while our payment processor retries the charge. If the payment still cannot be collected, your subscription is cancelled. No Credits are granted for a period that has not been paid.
• To update your payment method, select "Manage" on the Credits page.

11.5 Changing Plans

• Plans cannot be upgraded or downgraded in place at this time. To move to a different plan, cancel your current plan and subscribe to the new plan after the current period ends.
• You can have only one active subscription at a time.

11.6 Refunds

• Subscription fees are not refundable once a billing period has started, and unused subscription Credits are not refundable. To request a refund, follow Section 7.
• Cancelling stops future charges. It does not refund the current billing period.

11.7 Price Changes

• We may change plan prices. We will email you at least 7 and no more than 30 days before a price change takes effect. The notice will explain the change and how to cancel.
• A new price applies only to billing periods that start after the change takes effect. If you cancel before then, you will not be charged the new price.

11.8 California Residents

If you live in California, California's Automatic Renewal Law (Business and Professions Code sections 17600 to 17606) applies to your subscription. Nothing in these TOCs limits the rights it gives you.

These terms are governed by the laws of Pennsylvania, USA. Disputes will be handled in Lancaster County courts.
