1. Definitions

• "Service" means Moosky AI's website and AI video generation tools.
• "Credits" are digital tokens you purchase to run video generations.

2. License to Use

We grant you a limited, non-exclusive, non-transferable license to use the Service in compliance with these TOCs.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use.

4. Credits & Usage

• Credits expire only upon generation or account termination.
• Each generation deducts the specified credits.
• You acknowledge that credit consumption is irreversible except as noted in our Refund Policy.

5. Prohibited Conduct

• No unlawful, harassing, or infringing content.
• No attempts to reverse-engineer, scrape, or disrupt our Service.

6. Termination

We reserve the right to suspend or terminate accounts for violations of these TOCs, at our sole discretion.

7. Refund Policy

We sell credit packages for AI video generations. This policy explains when refunds are allowed.

• No refunds for credits already spent on successful generations.
• If a generation fails to produce any output due to system error, you may request a credit reinstatement.
• Unspent credits are non-refundable due to processing and transaction fees.

To request a refund for failed generations, email support@moosky.ai within 14 days of the failed request.

8. AI Content Disclaimer

All videos produced by Moosky AI are generated algorithmically and may contain inaccuracies, distortions, or fictional elements. You use the generated videos at your own risk. We do not guarantee the suitability, accuracy, or reliability of any AI-generated content.

9. Copyright & IP

9.1 Static Content Ownership

All text, images, graphics, and code on Moosky AI are owned by Moosky AI or its licensors. Unauthorized use is prohibited.

9.2 User-Generated Content

• You retain ownership of the copyright in videos you generate.
• By generating content, you grant Moosky AI a worldwide, royalty-free, sublicensable license to host, display, reproduce, and distribute your videos for service operation and promotional purposes.

9.3 Use of Copyrighted Materials

• Users may not upload, distribute, or otherwise use copyrighted works unless they have obtained explicit permission from the copyright owner.
• Users affiliated with an organization that owns the copyright must ensure they have proper authorization before using those assets.
• Responsibility for securing permissions rests solely with the user. The platform disclaims liability for unauthorized use of copyrighted materials.

9.4 Likeness and Voice (NO FAKES Act of 2025)

In accordance with the NO FAKES Act of 2025, users must obtain explicit consent from an individual before using their likeness, voice, or other identifiable attributes in any form, including but not limited to:

• Voice cloning
• Image animation
• Synthetic media generation
• The platform cannot verify whether such consent has been obtained. Users are solely responsible for ensuring compliance with applicable laws.
• Unauthorized use of an individual's likeness may result in account suspension and potential legal consequences.

9.5 DMCA Notice

If you believe your copyrighted work has been infringed, please provide a takedown notice to copyright@moosky.ai.

9.6 Liability Disclaimer

• The platform provides tools and services "as-is" and does not monitor or enforce permissions.
• Users assume full responsibility for any legal or financial consequences arising from unauthorized use of copyrighted materials or likenesses.
• By using the platform, users agree to indemnify and hold harmless the platform and its affiliates from any claims related to such misuse.

10. Data Retention

We retain user-generated content, including generated videos and associated job data, for 90 days from the date of creation. After this period, content may be permanently deleted from our systems without notice.

• Account information and transaction records are retained for as long as your account remains active or as required by applicable law.
• You may request early deletion of your generated content by contacting support@moosky.ai.
• Extended retention periods will be available for subscription plan holders in a future offering — subscribers will benefit from longer storage windows as part of their plan.

11. Dispute Resolution & Governing Law

These TOCs are governed by the laws of Pennsylvania, USA. Any disputes will be resolved in Lancaster County courts.
